  1. SMS TEXT PROGRAM DETAILS, CONTENT & SPECIFICATIONS 

Please read these terms and conditions carefully. By checking the box to sign up for our text messaging program(s), you expressly consent to receive non-marketing and marketing text messages from The Grand Prairie (“Provider”) on behalf of itself and others texting on its behalf, including text messages made with an autodialer, at the telephone number(s) that you provide. You may opt-out of these communications at any time, and consent to receive marketing text messages is not required to purchase any goods or services.

You also accept and agree to be bound by these SMS Text Terms and Conditions, the Provider’s Privacy Policy, and any other applicable terms and agreements related to your use of Provider’s services.

Terminology: “Alerts”, “text Alerts” or “text messages” may be used interchangeably in any other published information about this Provider service. All terms referring to this messaging service are considered bound by these Terms and Conditions.

Provider text messages are intended to provide you with information about Provider’s goods and services (e.g., Provider events, promotions, product launches, sweepstakes, and contests).

To receive Provider text messages, you must be a resident of the United States and 18 years of age or older. Provider reserves the right to require you to prove that you are at least 18 years of age.

Provider may revise, modify, or amend these SMS Text Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to Provider’s website. You agree to review these SMS Text Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive Provider text messages will indicate your acceptance of those changes.

In addition to the indemnification obligations set forth in the Provider’s Terms of Use, you agree that Provider, any carrier, and their parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, any companies who are promotional or marketing participants, and all of their respective officers, directors, employees, representatives and agents, will have no liability whatsoever for, and shall be held harmless by you against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any text message or participation in this text message program or any Provider related activity, or for any production, technical, typographical, human, or other error in the text message.

2. PROVIDERS, RATES & FREQUENCY

Your carrier’s standard text message rates apply to your entry or submission message, Provider’s confirmation, and all subsequent text messages. Other charges may apply. All charges are billed by and payable to your mobile service provider (please contact your mobile service provider for pricing).

Maximum number of text messages per month will vary based on the subscription list you’ve enrolled in. You will receive a maximum of ten (10) text messages per month per Provider text messaging program. Additionally, Provider reserves the right to alter text message frequency at any time i.e., Provider may change the frequency of texts that you receive under these alert programs. Provider will notify you via text if Provider changes the frequency and provide you with the opportunity to opt-out.

Supported carriers may change from time to time, but currently include AT&T, Verizon Wireless, Sprint, and T-Mobile USA, among others.

Provider will not be liable for any delays in the receipt of any text messages. Delivery is subject to effective transmission from your network operator.

3. OPT-IN INFORMATION

You can subscribe to Provider Alerts at any time by texting 346-359-1670.

4. OPT-OUT INFORMATION

You can unsubscribe at any time by texting STOP to 346-359-1670 and you will receive a text confirming that you have been unsubscribed for Provider’s text message list.

5. PRIVACY INFORMATION

You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying Provider immediately if you change your mobile telephone number. You agree to indemnify Provider in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Provider if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Data obtained from you in connection with this text messaging service may include your mobile phone number, your carrier’s name, and the date time and content of your text messages and other information you provide to Provider as part of this service. Provider may use this information to contact you and provide services you request from Provider. Provider may also use this information as described in the subscription list you’ve enrolled in.

7. TERMINATION

Provider may suspend or terminate your receipt of Provider text messages if Provider believes you are in breach of these SMS Text Terms and Conditions. Your receipt of Provider text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. Provider reserves the right to modify or discontinue, temporarily or permanently, all or any part of Provider text messages, with or without notice.

8. EMERGENCIES

For emergencies, please contact your local authorities directly.

9. COMMUNICATION & CONSENT

You may communicate with Provider via postal mail, telephone, and our website. Provider may issue notices via these various channels, including by sending e-mail to an address you provide. You agree that such notices shall have legal effect. You also agree that notices sent by e-mail satisfy any requirement that notices be provided in writing. If you do not agree, do not consent to continue to receive Provider text messages. You may have the right to withdraw your consent to receive certain electronic communications, and, when required by law, Provider will provide you with paper copies upon request. If you withdraw your consent, Provider reserves the right to terminate your use of Provider’s products or services, including Provider’s text messages to you.

To receive, access, and retain the notices that Provider sends via e-mail, you must have Internet access and a computer or device with a compatible web browser. You will also need software capable of viewing files in PDF format. Your device or computer must have the ability to print, or download and store, e-mails and PDF files. By accepting these terms, you confirm that you are able to receive, access, and retain the notices that Provider may send.

Realtor® Reward Program

  1. 2025 Closing Rewards offered:
    1. For each new home closing that occurs during the calendar year of 2025, the Realtor or broker will receive a closing award as follows:
      1. First closing: $250
      2. Second closing: $500
      3. Third or more closing: $1000
    2. To receive a Closing Reward or Monthly Drawing Reward, Collective “Closing Rewards”, the Tax Form W-9 must be filled out and submitted to EMBER Group business office, attention Cassidy Cryer at hello@thegrandprairietx.com. Winners are responsible for payment of any applicable taxes.
    3. Closing Rewards are only offered to the individual Realtor or broker that is named as the “broker” on the closing statement for a new home closing within a calendar quarter of 2025. Closing Rewards may not be transferred to another substitute Realtor or other person who is not the Realtor on the closing statements.
    4. A Realtor’s Closing Reward will be forfeited if the Realtor does not respond to the congratulatory email with their broker W-9 by the Closing Reward Deadlines specified below:
      1. FIRST QUARTER CLOSING REWARD DEADLINE IS APRIL 30, 2025. Realtors who close on a new home between January 1, 2025 – March 31, 2025 (herein referred to as “First Quarter”) must claim their reward on or before the April 30, 2025 expiration date.
      2. SECOND QUARTER CLOSING REWARD DEADLINE IS JULY 31, 2025. Realtors who close on a new home between April 1, 2025 – June 30, 2025 (herein referred to as “Second Quarter”) must claim their reward on or before the July 31, 2025 expiration date.
      3. THIRD QUARTER CLOSING REWARD DEADLINE IS OCTOBER 31, 2025. Realtors who close on a new home between July 1, 2025 – September 30, 2025 (herein referred to as “Third Quarter”) must claim their reward on or before the October 31, 2025 expiration date.
      4. FOURTH QUARTER CLOSING REWARD DEADLINE IS JANUARY 15, 2026. Realtors who close on a new home between October 1, 2025 – December 31, 2025 (herein referred to as “Fourth Quarter”) must claim their reward on or before the January 15, 2026 expiration date.

 

    1. Monthly Drawings Sweepstake
      1. The Grand Prairie Glow Getters Monthly Drawings Sweepstakes (the “Sweepstakes”) is open only to the Realtor or broker, listed as “broker” in the closing statement for that given month.
      2. By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws.
      3. Entries for the sweepstakes will be pulled from closings between the first day of the month to the last day of the month, every month from January 1,2025 and December 31,2025.
      4. The Sweepstakes are entered automatically upon receipt of closing information. The entry must fulfill all Sweepstakes requirements, as specified herein, to be eligible to win the Prize. Entries that are not complete, or that do not adhere to the Sweepstakes Rules, Terms or Conditions (“Rules”), may be disqualified at the sole discretion of Sponsor. Entrants shall furnish their first and last names, address, phone number, and email address. Entrants will have as many entries as the number of closings within the monthly time frame referenced above. If you use fraudulent methods or otherwise attempt to circumvent the Rules, your submission may be removed from eligibility at the sole discretion of Sponsor.
      5. One (1) winner will receive a voucher for $1,000 USD (one thousand US dollars). Actual Retail Value (“ARV”) of Prize is no more than $1,000 USD (one thousand US dollars). Sweepstakes Prize is not transferable. No purchase necessary. Purchase does not increase chance of winning.
      6. Drawings for the previous month will be drawn on the 15th of each month or on the following Monday if the 15th falls on a weekend. Once the winner has been drawn, notice to the winning Realtor or broker will be e-mailed to the e-mail address on file. A Realtor’s Monthly Drawing Reward will be forfeited if the Realtor does not respond to the congratulatory email with their broker W-9 by the Closing Reward Deadlines specified below

GPD and any direct or indirect partner, shareholder, member, officer, director, trustee, agent or employee or other representative of GPD is not responsible for any amount in excess of the value of the Closings Rewards or Monthly Drawings. Offers and incentives are void where prohibited or otherwise restricted by law. BASK IN THE GLOW MODEL HOME TOUR SWEEPSTAKES RULES, TERMS AND CONDITIONS

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

  1. Eligibility:The Grand Prairie Bask in The Glow Model Home Tour Sweepstakes (the “Sweepstakes”) is open only to those who complete an Entry Form at thegrandprairietx.com, and who are 18 years of age as of the date of entry. The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia, and is void where prohibited by law. Employees of the EMBER Group Entities, as defined herein, their immediate family members, and/or those living in the same household, are ineligible to participate in the Sweepstakes. The EMBER Group Entities consist of the following and their respective affiliates and subsidiaries: Grand Prairie Development Company (“Sponsor”) and its advertising and promotion agencies and suppliers, EMBER Group, and homebuilders that have contracted to build homes located within The Grand Prairie.
  2. Agreement to Rules:By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws.
  3. Sweepstakes Period:Entries will be accepted during the sweepstakes period using the registration form or at thegrandprairietx.com/where? starting at 10:00 a.m. CDT on March 28, 2025 and ending at 6:00 p.m. CDT on May 31, 2025. All entries must be received by 6:00 p.m. CDT on May 31, 2025 to be eligible.
  4. How to Enter:The Sweepstakes must be entered by visiting one of the new home models at The Grand Prairie and completing a Registration Form or scanning the onsite QR code. The entry must fulfill all Sweepstakes requirements, as specified herein, to be eligible to win the Prize. Entries that are not complete, or that do not adhere to the Sweepstakes Rules, Terms or Conditions (“Rules”), may be disqualified at the sole discretion of Sponsor. Entrants shall furnish their first and last names, address, phone number, and email address. You may enter only once and you must provide the information requested on the Registration Form. You may not enter more than once by using multiple email addresses, identities or devices in an attempt to circumvent the Rules. If you use fraudulent methods or otherwise attempt to circumvent the Rules, your submission may be removed from eligibility at the sole discretion of Sponsor.
  5. Prize, Approximate Retail Value (“ARV”)/Odds of Winning:Prize. One (1) winner will receive a voucher for $6,000 USD (six thousand US dollars) to put towards a trip to the Grand Cayman with Laura at Far Off Places & Beyond, LLC. ARV of Prize: up to $6,000 USD (five thousand US dollars). Sweepstakes Prize is not transferable.
    NOTE #1: Winner must travel reach out to Laura Buehner with Far Off Places & Beyond, LLC to redeem voucher at laura@faroffplacesandbeyond.com or 346-733-4947 on or before June 30, 2025, to be eligible.

NOTE #2: The prize winner must book their travel arrangements before December 31, 2025, and complete all travel by June 30, 2026. Failure to book within the specified timeframe will result in forfeiture of the prize. No credit or change will be given on any unused portion of the Voucher.

NOTER #3: The prize winner will book vacation components including hotel, cruise, airfare, airport transfers, travel insurance and/or activities, excursions with Laura at Far Off Places & Beyond, LLC. Any costs exceeding $6,000 are the sole responsibility of the winner and must be paid by the winner via credit card authorization. Unused portions of the $6,000 travel voucher will be forfeited and are non-refundable. All sales involving the use of the $6,000 travel voucher are final. A cash option, valued at 80% of the travel voucher ($4,800), may be available in lieu of travel. This prize is non-transferable and cannot be redeemed for cash, except for the cash option outlined above. By participating in this Sweepstake, winner agrees to Far Off Places & Beyond, LLC terms and conditions.
NOTE #4: Winner understands and agrees that transfer of the Prize to Winner may take place at a Prize ceremony, and that said ceremony may be videotaped and/or photographed. Rights to any video and/or photo footage of the Prize ceremony shall belong solely to Sponsor. Sponsor reserves the right to use any such footage in any media, at its sole discretion, as set forth in paragraph 7, below.
Odds of winning the Prize depend on the number of eligible entries received. If the Prize is legitimately claimed, it will be awarded. If unclaimed, the Prize may not be awarded. No cash or prize substitution allowed except at the sole discretion of the Sponsor, who may substitute a prize of equal or greater value for any reason. All prize details not specified in these Rules will be determined at Sponsor’s sole discretion. By participating, entrants agree to be bound by these Rules and the decisions of Sponsor, which are final and binding in all matters related to this Sweepstakes. Sponsor will not replace the Prize if it is lost, damaged, or stolen, or if the Winner is unable to travel to Houston, Texas to take possession of the Prize. If the Winner does not accept or take possession of the Prize, it will be forfeited and Sponsor will have no further obligation with respect to the Prize. No more than the stated Prize will be awarded. Acceptance of Prize constitutes permission for Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law, as set forth in paragraph 7, below.

  1. Winner selection and notification:Winner of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor on or about June 15, 2025. Winner will be notified within ten (10) days following the winner selection via phone call or email to the phone number or email address with which winner entered the Sweepstakes. Sponsor shall have no liability for a winner’s failure to receive notices due to winner’s spam, junk e-mail or other security settings, or winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to contact Sponsor within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, Prize may be forfeited and an alternate winner selected.

In the event of a dispute as to the identity of the winner based on an email address, the winning entry will be declared by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

The receipt by winner of the Prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. The potential winner must sign and return to the Sponsor, within fifteen (15) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility and Liability/Publicity Release in order to claim the Prize. [Note: The Affidavit of Eligibility will require that the winner provide their Social Security Number to the Sponsor, which will be used solely for tax reporting purposes.] The winner will be responsible for all local, state, and federal taxes associated with the receipt of the Prize. The value of the accepted Prize is taxable as income, and an IRS Form 1099 will be filed in the name of the winner for the value of the Prize. The winner is solely responsible for all matters relating to the Prize after it is awarded, including all expenses relating to the registration, licensing, use, acceptance and possession of the Prize, whether or not such expenses are mentioned herein.

ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AS DETERMINED BY SPONSOR AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

  1. Rights Granted by You:By entering this Sweepstakes, you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns, will have the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, your entry and name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without compensation (the “Advertising”). All copyright, trademark or other intellectual property rights in your entry, and all such Advertising making use thereof, shall be owned by Sponsor. By participating in the Sweepstakes, you hereby waive any claim or right, copyright, trademark, right of publicity, or other intellectual property rights in the entry or in any such Advertising, and waive any possible claims of misuse of your name, likeness or voice under contract, tort, or any other theory of law, arising out of such Advertising.
  2. Terms:Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should a virus, bug, non-authorized human intervention, fraud or other cause beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winner of the Sweepstakes from all eligible entries that, in Sponsor’s sole judgment, were unaffected. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Rules.

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes Rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

By entering the Sweepstakes you agree to receive email newsletters periodically from Sponsor. You can opt-out of receiving such communications at any time by clicking the unsubscribe link in the newsletter.
In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials, these Rules shall prevail, govern and control.

  1. Limitation of Liability:By entering you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) entrant’s participation in the Sweepstakes and/or entrant’s acceptance, possession, use, or misuse of the Prize; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries.
  2. Disputes:THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF TEXAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes that cannot be resolved between participant and Sponsor, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a state or federal court located in Harris County, Texas. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
